LeagueAtlas Inc. (hereinafter “HomeFoods”) is committed to protecting your privacy and safety rights while using HomeFoods’s application.

Definitions

For the purposes of this Privacy Policy, the following terms shall have the meanings set forth below:

• “Application”: The HomeFoods mobile and/or web application that facilitates connections between Home Culinary Providers and Customers.
• “Content”: All information, text, images, photos, audio, video, location data, and all other forms of data or communication that you submit to the Application.
• “Customer”: An individual who uses the HomeFoods Application to discover, order, and purchase food items from Home Culinary Providers.
• “Home Culinary Provider”: An individual or entity operating as a licensed microenterprise home kitchen operation under applicable state and local laws (such as California Health and Safety Code §114367 et seq.), or a cottage food operation (under California Health and Safety Code §114365 et seq.) with either a “Class A” registration (allowing direct sales only) or a “Class B” permit (allowing both direct and indirect sales). Home Culinary Providers must obtain all required permits, registrations, and licenses before offering food items for sale on the Application. These providers prepare homemade food items in accordance with applicable health and safety regulations.
• “Internet Food Service Intermediary”: As defined in California Health and Safety Code §114367.6, HomeFoods operates as an internet food service intermediary by providing a platform through which Home Culinary Providers may offer food for sale.
• “Non-Personal Information”: Data in a form that does not permit direct association with any specific individual.
•  “Order”: A transaction initiated by a Customer through the Application to purchase food items from a Home Culinary Provider.
• “Personal Information”: Information that is personally identifiable, such as your name, address, location data, payment information, e-mail address, or other contact information, and that is not otherwise publicly available.

What This Privacy Policy Covers

This policy covers how HomeFoods treats Personal Information that HomeFoods collects and receives, including information related to your past use of our Application and any services available on our Application.

This policy does not apply to the practices of companies that HomeFoods does not own or control (such as Apple, Inc., the Apple App Store, Google Play Store, or payment processors) or to people that HomeFoods does not employ or manage.

This policy does not apply to the practices of Home Culinary Providers who register and offer food items through HomeFoods, that respond to orders placed by Customers, or that otherwise participate in HomeFoods’s services. These Home Culinary Providers are independently permitted and licensed food facilities under applicable state and local laws. Customers who contact any such Home Culinary Provider directly, who place an order with such Home Culinary Provider, or who visit the location of any such Home Culinary Provider to pick up an order, are subject to the separate privacy practices of such Home Culinary Provider, which may differ from those set forth in this Privacy Policy.

This policy does not apply to Non-Personal Information. We may collect, use, transfer, and disclose Non-Personal Information for any lawful purpose, including but not limited to analyzing usage patterns, improving our service offerings, and enhancing the user experience.

Information Collection and Use

HomeFoods collects Personal Information when you register for an account, each time you use the Application services (including but not limited to social media applications), and when you enter HomeFoods promotions or special offer codes.

During registration, we gather information such as your name, e-mail address, physical address, phone number, profile name, and contact information. Once you create an account with HomeFoods and use our services, you are no longer anonymous to us.

If you provide your mobile phone number to HomeFoods, we may use it to deliver transactional SMS messages, such as:

• Verification codes during account signup or login;
• Order confirmations and updates regarding your order status;
• Customer support communications related to your orders.

HomeFoods does not sell or share your phone number with third parties for their marketing purposes.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties

You may opt out of receiving SMS messages at any time by replying with STOP. For assistance with SMS messages, reply HELP to any HomeFoods message or contact us at [email protected].

Message and data rates may apply, depending on your wireless carrier.

HomeFoods collects information about your transactions with us and with our business partners, including information about your Orders, payment methods, and usage patterns of the Application.

The Application may automatically receive and record information on our server logs from your browser and/or device, including your IP address, device type, operating system, and the pages or features you request.

To provide location-based services on the Application, HomeFoods may collect and use precise location data, including the real-time geographic location of your mobile device. If you opt in to HomeFoods’s location services, this location data is collected and is used by HomeFoods to provide and improve location-based products and services which HomeFoods offers.

HomeFoods uses collected information for the following general purposes: to customize the Application experience for both Customers and Home Culinary Providers, to verify the licensing and permit status of Home Culinary Providers, to process and fulfill Orders between Customers and Home Culinary Providers, to facilitate secure payments between parties, to improve our services and customer relations, to communicate important updates, policy changes, and promotional offers, to ensure compliance with applicable food safety regulations, to conduct research to improve our service and user experience, and to prevent and detect fraudulent activity and security breaches. HomeFoods may use collected information for other purposes not described herein.

For Home Culinary Providers, we may collect additional information related to their food preparation facilities, licensing information, permit numbers, inspection records, and food safety certifications as required by applicable laws governing microenterprise home kitchen operations and cottage food operations.

Minors

Persons under the age of 18 may not use HomeFoods in any way. HomeFoods will not knowingly contact persons under the age of 18 for marketing purposes without a parent’s permission. If HomeFoods learns that we have collected the personal information of a child under 18, we will take steps to delete the information as soon as possible.

HomeFoods may be used only by persons 18 years of age and older. When downloading the HomeFoods application, users will be asked to verify that they are at least 18 years of age and are legally able to enter into binding contracts under applicable state laws.

HomeFoods does not knowingly ask persons under the age of 18 for more personal information, as a condition of participation, than is reasonably necessary to use a given product or service.

Information Sharing and Disclosure

HomeFoods does not sell, rent, or share Personal Information about you with other people or nonaffiliated companies except to provide services that you have requested, when we have your permission, and under the following circumstances:

• We will share necessary information with Home Culinary Providers to facilitate Orders that you have placed through the Application. This includes your name, contact information, Order details, and pickup information. This sharing is essential to complete the transactions you initiate through our platform;
• We will provide contact and location information to Customers who have placed Orders with Home Culinary Providers, limited to what is necessary to facilitate pickup of ordered food items;
• We will provide information to trusted partners, service providers, and affiliates who work on behalf of or with HomeFoods. These companies may use your Personal Information to help HomeFoods process payments, verify licensing compliance, provide customer support, and communicate with you about offers from HomeFoods and our marketing partners. However, these companies do not have any independent right to share this information for their own purposes;
• We will provide the information in response to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or to defend against legal claims;
• We will provide information if we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected food safety violations, fraud, situations involving potential threats to the physical safety of any person, violations of HomeFoods’s Terms and Conditions of Use, or as otherwise required by law;
• We may share aggregated, non-personally identifiable information with third parties, including but not limited to the number of users in a particular region or the average transaction size, to help improve our services and develop new features;
• We will transfer information about you to our successors and assigns if HomeFoods is acquired by or merged with another company, or if HomeFoods sells all or substantially all of its assets to another company, or if a controlling interest in HomeFoods is transferred or sold to another company. In this event, HomeFoods will notify you before more information about you is transferred and becomes subject to a different privacy policy.

As required by California Health and Safety Code §114367.6 governing internet food service intermediaries and other relevant statutes, we may be required to share certain information about Home Culinary Providers with enforcement agencies, including but not limited to permit numbers and food safety complaints.

Confidentiality and Security

We limit access to Personal Information about you to employees who reasonably need to come into contact with that information to provide products or services to you or to perform their job responsibilities.

We employ physical, electronic, and procedural safeguards to protect Personal Information about you, including but not limited to:

• Your HomeFoods account is password-protected and we recommend using strong, unique passwords;
• In sensitive areas, HomeFoods uses industry-standard encryption to protect data transmissions, including SSL/TLS encryption for all data transfers;
• We implement regular security audits and vulnerability testing on our systems
• We utilize secure cloud infrastructure with appropriate access controls
• All payment information is processed through PCI-compliant payment processors

We implement special security measures to protect the home addresses of Home Culinary Providers. Location information of Home Culinary Providers is only shared with Customers who have placed and paid for an Order, and only for the purpose of pickup.

We also implement security measures designed to protect Customer information during the Order process, sharing only the minimum information necessary with Home Culinary Providers to fulfill Orders.

HomeFoods cannot guarantee absolute security, as no method of data transmission or storage on the internet is 100% secure. Providers of mobile telephone hardware (such as Apple iPhone), software (such as iOS or Android), and networks (such as cellular carriers) take their own precautions to safeguard your information. HomeFoods is not responsible for any disclosure of your Personal Information should any of these third-party measures fail for any reason. HomeFoods is not responsible for any disclosure or “leak” of your personal and nonpersonal information should any of these measures fail to work for any reason.

In the event of a data breach that affects your Personal Information, we will notify you in accordance with applicable laws and regulations.

For California Users

The California Civil Code requires a business with whom a California resident has an established business relationship to disclose to such residents, upon their request: 

(1) the types of personal information the business shares with third parties for the third party’s marketing purposes; and 

(2) the identities of the third parties with whom the business has shared this information during the immediately preceding calendar year.

Changes to this Privacy Policy

HomeFoods may update this policy. We will notify you about significant changes in the way we treat personal information by placing a prominent notice on the HomeFoods application or by sending a notice to the Facebook address you provide when logging in to the HomeFoods application.
